Court says Parking Rules Won't be Enforced in Five Points

The 22 spaces on Lumpkin Street remain in legal limbo.

 

It has yet to be determined whose parking places they are, but for now, no one will be ticketing cars parked in front of Stiles Apartments in Five Points.

The Georgia Supreme Court has upheld a ruling by a lower court judge that prohibited from having the area patrolled for parking violations. ACC officials intended to engage parking employees of the Athens Downtown Development Authority, which handles parking issues downtown, to enforce parking rules.

ACC appealed the lower court’s decision, and lost. With this ruling, the county can now move forward, if it wishes, to ask for a court ruling on who owns the parking spaces.

In 2010, Barry Stiles, who owns the mixed use building on Lumpkin Street, sued Athens-Clarke County, saying he owns the 22 parking spaces in front of the building and that they are for the use of his commercial tenants.

County attorneys cite a 1954 agreement between the City of Athens and Stiles’ father in saying the parking spaces are for the public’s use.
